§ 1 Scope
These Terms of Service ("ToS") govern the use of the aiou.io platform ("Service"), operated by UVND Technology e.K. ("Provider"), by its users. The offer is directed at consumers and entrepreneurs.
§ 2 Subject of the Contract
- The Provider offers a platform that enables users to create, edit, and publish websites and associated server-side logic ("Projects") using artificial intelligence (AI).
- The Provider reserves the right to use and exchange various specialized third-party providers and technologies at its own discretion to provide the AI services (e.g., for speech processing, image, or code generation) to ensure the quality and efficiency of the Service.
- The Service includes hosting for the created Projects. The technical provision of hosting may be carried out by one or more cloud hosting partners.
§ 3 Registration and User Account
- Use of the Service requires a user account, created by providing an email address and confirming via a one-time password (OTP).
- The User is responsible for the security of their email account and for protecting their login emails from unauthorized access.
§ 4 Credits and Payment
- The use of AI functions and domain hosting are billed via a credit system.
- Upon registration, the User receives a one-time free allotment of credits. Additional credits can be purchased for a fee through an external payment service provider.
- Purchased credits are non-refundable and non-transferable.
§ 5 Domain Services and Hosting
- Subdomains: Each Project is accessible via a subdomain provided by the Provider.
- Domain Purchase and Management:
a. The Provider may act as an intermediary for the registration of custom domains with a third-party registrar on behalf of the User. The User becomes the legal owner of the domain.
b. Domain hosting costs are billed in credits for a three (3) month period in advance.
c. It is the User's sole responsibility to ensure their credit account is sufficiently funded for the timely renewal of their domains. If the credit balance is insufficient, the renewal will fail. The domain will then be unlinked from the Project and may become available to third parties or be otherwise used by the Provider after its registration period expires.
- External Domains: Users can connect their own domains by configuring DNS records.
- Publication: The code created by the User is published on the infrastructure of one or more cloud hosting partners.
§ 6 User Obligations and Content
- The User is solely responsible for all content they create, upload, and publish.
- The User warrants that their content does not violate applicable law or third-party rights.
- The User shall indemnify the Provider against all third-party claims arising from a legal infringement by their content.
- The Provider is entitled to block or delete illegal content or Projects without prior notice.
§ 7 Limitation of Liability and Availability
- The Provider is liable without limitation only for intent and gross negligence, and for injury to life, body, or health. In cases of slight negligence, the Provider is only liable for the breach of essential contractual duties and only for the contract-typical, foreseeable damage.
- The Service is provided "as is" and without a guarantee of uninterrupted availability. In particular, no liability is assumed for the correctness, completeness, or functionality of the code generated by the AI. The review and adaptation of the code are the User's responsibility.
§ 8 Contract Duration and Termination
- The user contract is for an indefinite term and can be terminated by the User at any time.
- The Provider may terminate the contract with a notice period of four (4) weeks. The right to extraordinary termination for good cause remains unaffected.
- Upon termination, any remaining credit balance is forfeited.
§ 9 Right of Withdrawal for Consumers
You have the right to withdraw from this contract within fourteen days of its conclusion without giving any reason. To exercise this right, you must inform us via a clear statement (e.g., by email). If you withdraw, we will reimburse all payments received from you.
The right of withdrawal expires prematurely for contracts for the supply of digital content (e.g., credits) if you have expressly consented to the performance of the contract beginning before the withdrawal period expires, acknowledging that you thereby lose your right of withdrawal.
§ 10 Final Provisions
- The law of the Federal Republic of Germany shall apply.
- The place of jurisdiction for merchants is the business seat of the Provider.
- The Provider reserves the right to change these ToS. The current version is available on the Service's website. By continuing to use the Service after a change, the User agrees to the new ToS.
